Terms & Conditions.

The rules. Read them. By using Vidizzy you agree to all of them. We've tried to write them in plain English so you don't have to be a lawyer to understand what you're signing up for.

The short version

TL;DR

You're 18+. You're responsible for what you do on the site. We don't moderate live conversations in real time — if something is wrong, hit Report. If something goes seriously wrong, you and Vidizzy resolve it through arbitration, not court. We can change or shut down the service at any time. Don't break the law on Vidizzy. The rest is the legal version of those four sentences.

Acceptance of terms

These Terms & Conditions ("Terms") govern your access to and use of vidizzy.cam and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

These Terms constitute a binding legal agreement between you and Vidizzy ("we," "us," "our," "Vidizzy"). You confirm that you have the legal capacity to enter into this agreement.

Eligibility & age

Strictly 18+

The Service is available only to individuals aged 18 years or older. By using Vidizzy, you represent and warrant that you are at least 18 and have the legal capacity to enter into these Terms.

If you are under 18, you may not use the Service under any circumstances, even with parental consent. We reserve the right to terminate accounts and access of any user we suspect to be underage.

The Service may not be available to users in jurisdictions where its use would violate local law. You are responsible for determining whether your use of the Service is legal where you are.

The service

Vidizzy is a free, anonymous, browser-based random video chat service that connects users in 1-on-1 video conversations. The Service does not require account registration. Video chat sessions are delivered through a third-party WebRTC chat module embedded on the Site (see Section 10).

We may modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice, and without liability to you. We do not guarantee that the Service will be available, uninterrupted, or error-free at any specific time.

Acceptable use

You agree to use the Service only for lawful purposes and in a manner that respects other users. You agree to:

  • Comply with all applicable laws and regulations
  • Treat other users with basic respect
  • Use the Service only for personal, non-commercial purposes (unless we authorize otherwise in writing)
  • Provide accurate information when contacting us
  • Take responsibility for the security of your device and your browser permissions

Prohibited conduct

You agree NOT to use the Service in any way that involves:

  • Minors — using the Service if you are under 18, attempting to contact minors through the Service, or sharing or soliciting any content involving minors. Violations will be reported to law enforcement and the National Center for Missing & Exploited Children (NCMEC).
  • Illegal activity — using the Service to commit, plan, or facilitate any criminal act, including but not limited to fraud, harassment, threats, stalking, distribution of controlled substances, or human trafficking
  • Harassment and abuse — threatening, intimidating, harassing, bullying, or stalking other users; doxxing or sharing private information about others without consent
  • Hate speech — promoting violence, discrimination, or hatred against any group based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected characteristic
  • Non-consensual content — recording, capturing, or distributing other users' video, audio, or images without their explicit consent
  • Impersonation — pretending to be someone else, including a real person or organization, in a way that misleads other users
  • Commercial use — soliciting, advertising, scamming, phishing, or attempting to extract money from other users; running unauthorized businesses through the Service
  • Technical abuse — attempting to access the Service or other users' data through unauthorized means; reverse-engineering, scraping, or interfering with the Service; introducing malware, viruses, or harmful code; using automated tools or bots
  • Content that violates law — sharing or soliciting any content that is unlawful in your jurisdiction or in the United States
  • Circumventing safety measures — attempting to bypass age verification, moderation, reporting, or any other safety feature of the Service

Violations of this section may result in immediate termination of access, IP-based blocks, and reports to law enforcement where appropriate.

Reporting & moderation

The Service includes tools for users to report misconduct. We rely substantially on user reports to identify violations because we do not surveil live conversations. When you encounter behavior that violates these Terms, please report it through the in-chat report feature or by contacting us through our contact page.

We may use automated and manual review tools to detect and respond to violations, including AI-assisted moderation. We do not pre-screen every chat, and we do not guarantee that all violations will be identified or addressed. Decisions about moderation, suspensions, and bans are at our sole discretion.

You acknowledge that despite our efforts, you may encounter content or behavior on the Service that is offensive, illegal, or otherwise objectionable. You assume all risk of exposure to such content and agree that we are not responsible for the conduct of other users.

Your content

The Service does not record or store your video or audio chats. Any content you transmit through the Service ("Your Content") is solely between you and the user(s) you are connected with. You retain whatever rights you have in Your Content under applicable law.

By using the Service, you grant us a limited, non-exclusive, royalty-free license to access and process Your Content as necessary to operate the Service, respond to safety reports, and comply with legal obligations. This license does not give us the right to monetize, distribute, or republish Your Content.

You are solely responsible for Your Content. You represent and warrant that Your Content does not violate any law, infringe any rights of any third party, or breach these Terms.

Intellectual property

The Service, including the Vidizzy name, logo, design, code, copy, graphics, animations, and all other elements (collectively, "Vidizzy IP"), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the Service or any part of it without our prior written consent.

Any feedback, suggestions, or ideas you submit to us about the Service may be used by us for any purpose without compensation or attribution.

Third-party services

The video chat functionality on Vidizzy is provided by a third-party WebRTC service embedded on the Site as an iframe. Your use of the chat module is also subject to that provider's terms of service and privacy policy. Vidizzy is not responsible for the practices, security, or content of third-party services.

The Site may link to other websites or services we do not control. Your interactions with those services are governed by their own terms.

Disclaimers

The service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

We do not warrant that:

  • The Service will meet your requirements or expectations
  • The Service will be uninterrupted, timely, secure, or error-free
  • Any information obtained through the Service will be accurate or reliable
  • The conduct of other users will be lawful, safe, or appropriate
  • Any defects in the Service will be corrected

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by law, in no event shall Vidizzy, its officers, employees, agents, partners, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your access to or use of (or inability to access or use) the service.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total cumulative liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed one hundred United States dollars (US$100.00).

Some jurisdictions do not allow the exclusion or limitation of liability for certain damages, so some of these limitations may not apply to you. In such jurisdictions, our liability is limited to the smallest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Vidizzy, its affiliates, officers, employees, agents, partners, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including any intellectual property, privacy, or publicity right; or (d) any content you transmit through the Service.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

DMCA / copyright

If you believe that content accessible on or through the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) by contacting our designated agent through our contact page with the following information:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing material and where it is located on the Service
  • Your contact information (address, phone, email)
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner

Because the Service does not record or store user-generated content, most DMCA scenarios will not apply. However, we will respond to valid notices about static content on the Site itself.

It is our policy to terminate, in appropriate circumstances, the access of users who are repeat infringers.

Termination

We may suspend or terminate your access to the Service at any time, for any reason or no reason, with or without notice, including (without limitation) if we believe you have violated these Terms.

You may stop using the Service at any time. Because the Service does not require an account, you simply close the page.

Sections that by their nature should survive termination (including but not limited to disclaimers, limitations of liability, indemnification, intellectual property, governing law, and dispute resolution) will survive termination.

Arbitration & class waiver

Important — please read carefully

This section requires you and Vidizzy to resolve most disputes through binding individual arbitration rather than in court, and waives your right to participate in class actions. By using the Service, you agree to this arbitration clause.

Mandatory binding arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your use of the Service ("Dispute") shall be resolved exclusively through final and binding individual arbitration, except as set forth below.

The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at www.adr.org. The arbitration will be conducted in English. The seat of arbitration shall be San Francisco, California, unless you and we agree otherwise. Either party may participate by telephone or video for arbitrations involving claims of US$10,000 or less.

Class action waiver

You and Vidizzy each agree that any Dispute will be brought solely on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate more than one person's claims, and may not preside over any form of representative or class proceeding.

Exceptions

Either party may bring an individual claim in small-claims court for disputes within that court's jurisdiction. Either party may also seek injunctive or equitable relief in court to protect its intellectual property rights.

30-day opt-out

You may opt out of this arbitration agreement by sending written notice via our contact page with the subject line "Arbitration Opt-Out" within 30 days of first using the Service. The notice must include your name, address, and a clear statement that you wish to opt out. Opting out will not affect any other provision of these Terms.

Severability

If the class action waiver is found unenforceable, then the entirety of this arbitration section shall be null and void as to such Dispute, but shall remain in effect for all other Disputes.

Governing law

These Terms and any Dispute arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-laws principles.

Subject to the arbitration provisions in Section 16, you and Vidizzy agree that the exclusive jurisdiction and venue for any judicial proceeding (including small-claims actions and actions to enforce arbitration awards) shall be the state or federal courts located in San Francisco County, California. You consent to the personal jurisdiction of such courts.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Changes to these terms

We may modify these Terms at any time. When we make material changes, we will update the "Effective" date at the top of this page and post a notice on the Site. Your continued use of the Service after changes are posted means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
